SECTION 21 NOTICE - NOTICE REQUIRING
POSSESSION |

This is certainly a
very important document and should be prepared with great attention to detail.
Many claims for possession are rejected because of minor errors in the Section
21 Notice and accordingly, we now include the preparation of this in our
service.
IMPORTANT - THE COURT WILL NOT GIVE
POSSESSION IF THE APPROPRIATE NOTICE HAS NOT BEEN SERVED.
There
are a number of important considerations when issuing a Section 21 Notice:
- The date the tenant
first moved in.
- The dates the rent is
due.
- The end date of the
tenancy this will be confirmed on the Tenancy Agreement
- Whether the Tenancy
Agreement has expired or not.
- Who the Section 21 will
be served on (if more than one tenant each must be served).
- The date of
service.
- The method of
service.
Method of service can include:
- Handing the document to
the tenant in person (take a witness).
- By post.
- Posting through the
tenant's letterbox (take a witness).
If posting, recorded delivery is not
recommended. Many people refuse to sign for recorded postal packets. It is far
better to obtain a Certificate of Posting from the post office.
If
serving in person you may be able to obtain a signature from the tenant -
although many do refuse. If you take a witness - very advisable - your
witness will be able to confirm.
