PROPERTY DILAPIDATIONS
The landlords'
property is their asset and both deliberate and accidental damage decreases the
value of that asset. If the property is to be re-let to a future tenant repairs
may need to be carried out and the cost of these repairs must be covered by the
outgoing tenant.
The landlord should mitigate the risk of serious
damage by regularly inspecting the property. In addition, there should be
condition checks carried out at the time of occupation and on vacating.
If, during the term of the letting contract, serious dilapidations are
noted the landlord has the option to demand the cost of remedial work from the
tenant or, if the tenant refuses to comply, to evict the tenant.
Frequently, dilapidations are noted and quantified after the tenant has
vacated. In this instance the landlord should retain the
security deposit and if this fails to cover
the cost of remedial work pursue the ex-tenant for redress. If necessary the
