ILLEGAL EVICTION
It is normally
illegal for a landlord to evict a tenant without a court order. Brute force,
the changing of locks while the tenant is out and removing the tenant's
possessions without a court order are all illegal and dealt with seriously by
the courts.
However, where the tenant shares the living space with the
landlord this does not apply and the tenant does not have such protection under
the law.
Harassment If the landlord
deliberately renders the property untenable, threatens the tenant, subjects the
tenant to load noise or other methods of depriving the tenant of "the quite
enjoyment of the property" this is harassment and the tenant has the right to
take legal action and obtain a court injunction restraining the landlord.
The Protection of Harassment Act 1997 deals with this matter offering full
protection to the tenant (amongst others). |
