CONTRACT TYPES
The contracts
(Tenancy Agreements) for rented residential property come under three main
headings:
- Private
tenancies.
- Council
tenancies.
- Housing
Association tenancies.
This web site deals with private
tenancies which can be one of the following:
- An Assured
Shorthold tenancy.
- An Assured
tenancy.
- A Regulated
tenancy.
- A
Licence.
Most private tenancies these days are
Assured Shorthold tenancies and the property, whether a house or flat, is
usually furnished. The contract period is usually six months and terminates at
the end of the six month period. It is prudent for the landlord to to give the
tenant Notice of Possession at least two months prior to the expiration of the
six month period (citing the termination date on the contract).
The
Assured tenancy gives the tenant significantly more protection and accordingly
is far less common than the assured shorthold tenancy.
A Regulated
tenancy provides both landlords and tenants with the facility to apply to the
Rent Service for a "fair rent" to be fixed. The "fair rent" is set for a period
of two years and depending on the circumstances can be set at either a higher
or a lower level than the previous rent.
A Licence is usually applied to
a shared flat or house or to a property which is supplied as part of the
licensee's job. Licensees have fewer rights than tenants and in some cases any
notice to quit need only be reasonable and need not be in writing. |
